Scope of Application

This statement applies to the use of services and materials of OPG TOMICA by OPG TOMICA clients as well as to employment within OPG TOMICA.

Please note that, in the course of improving our activities and enhancing our services, updates to this Privacy Policy may be necessary. In such cases, we will inform you accordingly.

Which Data Is Collected and Transmitted

The personal data we process are data about you as a client, collected when you place orders or visit OPG TOMICA, or when you complete the Client Consent Form; data about you as an employee of OPG TOMICA based on the Labor Act and other applicable regulations; data collected during your payments via bank transfer; or data arising from the establishment and execution of contractual relations between you and OPG TOMICA, which can be directly or indirectly linked to you. These data include the following: full name, telephone number(s), residential address, e-mail address, date of birth, personal identification number (OIB), and bank details in case of payments via bank transfer.

Cookies

Google AdWords Conversion Tracking

This allows the creation of conversion statistics that measure the effectiveness of our online advertising campaigns. The conversion tracking cookie is set when a user clicks on an ad placed by Google. According to Google’s data protection provisions, no personal data is processed. If you do not wish to participate in tracking, you can disable the use of data for this purpose by deactivating Google’s conversion tracking cookie through your web browser’s cookie settings.

Please note that current web browsers accept “cookies” according to their default settings. You can configure your browser settings so that it does not allow all or certain cookies, or so that you are prompted to approve the acceptance of a new cookie. Conversion Measurement Using Facebook Visitor Activity Tracking Pixels

As part of our online presence, the Facebook Visitor Activity Tracking Pixel from Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”) is used. This is a “cookie,” i.e., a small text file stored on your computer that can be read from your computer. It allows user activities to be tracked after they have seen or clicked on an ad on Facebook. In this way, the effectiveness of Facebook ads can be measured for statistical evaluation and market research purposes. The data collected in this manner is anonymous to us, i.e., it cannot be linked to the identity of the user. However, this data is stored and processed by Facebook, so it can be linked to the user’s profile, and Facebook may use it for its own advertising purposes in accordance with Facebook’s Data Policy (“http://www.facebook.com/about/privacy/” ). You can allow Facebook and its partners to serve ads on Facebook and outside of Facebook. For this purpose, a cookie will be stored on your computer. Sharing

Our website integrates social media sharing buttons for Facebook, 1601 South California Avenue, Palo Alto, CA 94304, USA, as well as Instagram, San Francisco, California, USA. In addition, a sharing button via e-mail may also be integrated. You can recognize the sharing buttons by their respective logos.

Only when you click on the respective “sharing button” on our website (and only then) is a direct connection established between your browser and the server of the respective social network operator. According to the operators of the mentioned social networks, no personal data is collected by the social networks without clicking on the respective sharing button. Only for users who are logged into the respective social networks are such data, including your IP address, collected and processed. If you do not want your visit to our website to be linked to your user account on the social networks, please log out of your account on the respective social network.

We emphasize that OPG TOMICA has no access to the content of the data transmitted, nor to its use by the social networks. More information on how the social networks use the data can be found in the respective social network’s Privacy Policy.

Use of Data

We use your personal data fully in accordance with legal provisions.

The personal data you provide to us when placing orders and visiting OPG TOMICA, when completing the Client Consent Form, during your payments via bank transfer, or when establishing and executing contractual relationships between you and OPG TOMICA, will be collected and processed exclusively within the framework of fulfilling our legal obligations (for example, data about employees that OPG TOMICA is required to collect under the Labor Act) or contractual obligations towards you based on your consent.

After you provide us with your explicit consent, we will use your data for delivering materials related to the respective services, for mutual communication, including birthday greetings, and related actions and activities, as well as to inform you about OPG TOMICA’s service offerings, discount promotions, new products, workshops, trainings, promotions, and for the purpose of promoting OPG TOMICA.

Data Security and Transmission

To protect your data, we use passwords, web firewalls, antivirus programs, and other security measures according to the current state of technology. When communicating via e-mail, the security of data during transmission can only be guaranteed according to the current state of technology.

Client data provided in the Client Consent Form is stored both in the original form and electronically. The originals of these forms are kept in a cabinet secured with a key, while access to the list of OPG TOMICA clients and the client data stored electronically is protected by a password. The retention period for these data is two years from the date of the client’s last interaction with OPG TOMICA.

The originals of the Client Consent Forms are physically destroyed two years after the date of the client’s last interaction with OPG TOMICA.

Access to the list of client data and Client Consent Forms is granted to the director of OPG TOMICA as the responsible person, and to OPG TOMICA employees, as such access is necessary for fulfilling the obligations and services of OPG TOMICA to the respective clients. This access is regulated in accordance with applicable legislation. Every client has the right to access the personal data held about them in the OPG TOMICA client list and processed about them (for example, in the list of service users).

Personal data provided by the client for the purpose of bank payments are collected electronically and stored on a computer, with access protected by a password. Access to these data is granted to the director of OPG TOMICA. The retention period for these data is determined in accordance with applicable regulations, particularly accounting regulations.

Personal data that are collected are retained only as long as necessary to fulfill the purpose of data collection and processing. Client data provided in the Client Consent Form, collected for the purpose of sending notifications about OPG TOMICA’s services and promotion, are retained until the client withdraws consent, or at the latest, until two years after the client’s last interaction with OPG TOMICA.

Responsible persons and employees of OPG TOMICA who have the right and authority to access personal data collected by OPG TOMICA are obliged, by signing the Confidentiality Statement, to maintain the confidentiality of personal data permanently and to act in accordance with applicable legislation and OPG TOMICA’s internal rules.

Your personal data may be transferred or disclosed to certain contractual partners of OPG TOMICA if OPG TOMICA decides to engage them.

We may engage certain partners to fulfill our obligations (for example, accounting services) and provide services, communicate with members, manage our online presence and access, or fulfill any of the purposes set out in this Statement. Your personal data will be transferred to an OPG TOMICA contractual partner only if it is necessary to perform a specific service related to you. These contractual partners will be carefully selected to ensure lawful and secure data processing. Furthermore, these partners are obliged to use your personal data solely for the specified purposes in accordance with our instructions and in compliance with Croatian data protection legislation. Use of the data by contractual partners for other purposes is strictly prohibited.

We will not transfer your personal data to any other persons except the aforementioned contractual partners, unless you have given your consent to do so.

Considering the nature, scope, purpose of collection, use, and processing of personal data by OPG TOMICA, including the fact that the collection, use, and processing are not extensive, and that no special categories of personal data are collected, OPG TOMICA and its services are not subject to a legal obligation to appoint a Data Protection Officer. Therefore, OPG TOMICA does not have an appointed Data Protection Officer.

Right of Withdrawal, Access, Correction of Data, and Contact

By signing the Client Consent Form or by using our website, you agree to the use of your personal data in the manner described in the Client Consent Form and in this Data Protection Statement.
